Terms and Conditions of Contract

These Terms and Conditions regulate the contracting of classes, monthly fees, individual classes, private classes, workshops, sessions, activities and other services offered by Urvashi Yoga Estudio through the https://urvashiyogaestudio.com/ website, as well as through other contact channels enabled by the center.
The contracting of any of the services implies the reading, understanding and express acceptance of these Terms and Conditions by the student or user.

Hereinafter, the “Center”.
Purpose
This document regulates the conditions applicable to the contracting of the services offered by Urvashi Yoga Studio, including:
– Group yoga classes.
– Monthly regular attendance fees.
– Single classes.
– Private classes at the center.
– Private home lessons.
– Yoga Nidra sessions.
– Workshops, events and special activities.
– Any other service related to the practice of yoga, meditation, well-being or related activities offered by the Centre.
3. Contracting modalities
The student may contract the services available at any time according to the modalities published by the Center, which may include monthly fees, individual classes, private classes, workshops or specific activities.
The rates, timetables, duration of the classes, availability of places and specific conditions of each service will be indicated on the website, at the centre or in the usual communication channels of the Centre.
The Centre may update its opening hours, rates, services and internal conditions when necessary for the correct organisation of the activity.
4. Monthly Fees
The monthly fee allows the student to attend the classes corresponding to the contracted modality during the current month, according to the schedules and places available.
The monthly fee must be paid during the first week of each month or on the date established at the time of contracting. In the case of contracting by recurring payment, the student expressly authorises the Centre to make the periodic charge of the corresponding fee through the selected payment method.
The monthly fee is personal and non-transferable. It may not be transferred to another person unless expressly authorised by the Centre.
Once the monthly fee has been paid, no refunds, refunds or financial compensation will be made for the student’s lack of attendance, without prejudice to the recovery options that the Centre may offer in accordance with its internal rules.
5. Recurring payments
When the student contracts a monthly fee with recurring payment, he/she authorises the Centre to automatically charge the corresponding amount to the bank card, Bizum or other enabled payment method, with the periodicity indicated in the contracting process.
The recurrence will be monthly, unless another periodicity is expressly indicated at the time of contracting.
The student declares that he/she is the legitimate owner or authorized user of the means of payment used and undertakes to keep it active, valid and with sufficient balance to meet the corresponding charges.
The recurring charge will be made for the amount of the fee in force at any given time, previously informing the student. In the event of a change in fares, the Centre will notify the change with reasonable notice before applying the new amount.
6. Payment Methods
Payments may be made using the methods enabled by the Centre at any given time, including:
– Bank card.
– Bizum.
– Bank transfer.
– Other means of payment expressly accepted by the Centre.
Online payments by card or Bizum will be managed through a secure payment gateway provided by the corresponding bank or payment service provider, currently through Redsys or the system that replaces it in the future.
Urvashi Yoga Studio does not store the student’s full bank card details. The management, validation and custody of payment data is carried out directly through the secure payment gateway and the entities involved.
7. Confirmation of the contract
The contract will be confirmed once the payment has been correctly validated by the payment gateway or by the corresponding means of payment.
In the case of individual classes, private classes, workshops or activities with limited places, the place will only be reserved when the payment has been made and confirmed by the Centre.
If the payment is not completed correctly, the contract will not be considered formalized and the Center will not be obliged to reserve the place or provide the requested service.
8. Non-payments, rejected payments or collection incidents
If a recurring charge is rejected by the bank, due to lack of balance, expired card, error in Bizum, cancellation of the means of payment or any other cause beyond the control of the Centre, the student must regularize the pending payment as soon as possible.
The Centre may contact the student to facilitate a new payment attempt or an alternative payment method.
While there is a pending payment, the Centre may temporarily suspend access to the classes, activities or services contracted until the debt is regularised.
Bank charges, commissions or costs arising from refunds, rejections of charges or non-payments attributable to the student may be passed on to the student when appropriate and provided that they have been previously informed.
9. Cancellation of the monthly fee or cancellation of the recurring payment
The student may request the cancellation of their monthly fee or cancellation of the recurring payment by notifying the Centre in writing via email info@urvashiyogaestudio.com, WhatsApp or any other channel enabled by the Centre.
To avoid the following month’s charge, the cancellation request must be made at least 5 calendar days before the next charge.
If the request is made outside this period and the charge for the following period has already been processed, the cancellation will be applied to the subsequent period, without this generating the right to a refund of the amount already collected.
The cancellation of the fee will not affect payments already made or services already provided or made available to the student during the contracted period.
10. Single classes
Single classes must be paid for and confirmed each time the student wishes to attend.
The place in a single class will only be reserved when the payment has been made and confirmed by the Center.
In case of not being able to attend, the student must notify it as far in advance as possible to facilitate the organization of the class and allow another person to occupy the place.
11. Class Recovery
Classes not taken may only be made up in the cases, deadlines and times established by the Centre.
In general, recoveries must be made within the current month. When the absence occurs at the end of the month, the Centre may allow recovery during the first week of the following month, provided that there are places available.
In order to make up a class, the student must notify their absence at least one hour before the start of the class. If the student does not notify within this period or does not attend the booked class, the class may be considered lost.
Recoveries will always be subject to availability of places and schedules. The impossibility of recovering a class will not generate the right to a refund, discount or financial compensation in subsequent monthly payments.
The additional or extraordinary recoveries that the Centre may offer will be voluntary and courtesy, without constituting a permanent contractual obligation.
12. Private lessons, individual sessions and special activities
Private lessons, individual sessions, home classes, workshops and special activities may have specific conditions of reservation, payment, cancellation and refund.
Unless otherwise stated, these activities must be paid in advance to confirm the reservation.
In the event of cancellation by the student, the Centre may require a minimum notice to be able to change the date or keep the amount paid as a credit for another session. If the cancellation is made without sufficient notice or the student does not show up, the Centre may consider the session as having been carried out.
When an activity has particular conditions, these will be communicated before contracting and will prevail over the general conditions in what is specific.
13. Withdrawal, cancellations and returns
In accordance with the applicable regulations, the student may exercise the rights that correspond to them as a consumer or user.
However, once the contracted monthly period has begun, a class has been held, a place has been reserved or the service has been provided in whole or in part, the amount paid will not be refunded, unless cancellation attributable to the Centre or a legally foreseen cause.
In the case of monthly fees, the payment entitles access to the corresponding classes and services during the contracted period. Failure to attend due to the student’s decision, personal availability, illness, travel or other circumstances will not give the right to a refund, without prejudice to the recovery options provided by the Centre.
If a class, workshop or activity is cancelled for reasons attributable to the Centre, the student will be offered, as the case may be, a new date, a recovery, an equivalent credit or a refund of the amount paid for the service not provided.
14. Changes to schedules, fares or services
The Centre may modify timetables, teachers, rates, location of certain activities, calendar, internal rules or availability of classes when there are organisational, technical, professional or force majeure reasons.
When such changes significantly affect active recruitment, the Centre will inform the student as far in advance as possible.
Changes in fees will apply to future contracts or renewals, not to periods already paid, unless expressly accepted by the student.
15. Month of August and special periods
During the month of August or other special periods, the Centre may modify its activity, reduce opening hours, close temporarily or apply different conditions, which will be communicated to students with reasonable notice.
In the event that the school remains closed or a special system of contributions, donations or internal operation is applied, these conditions will be informed in advance to the students.
16. Standards of Attendance and Behavior
The student undertakes to respect the rules of operation of the Centre, as well as the space, the material, the timetables, the teachers and the rest of the students.
To promote the correct development of the internship, punctuality is requested. The Centre may close the door a few minutes before the start of the class to avoid interruptions.
The student must use the material carefully, leave it correctly collected and maintain a respectful attitude during the stay at the center.
The Centre reserves the right of admission or permanence when the behaviour of a person alters the correct development of classes, causes inconvenience to other students, damages the material or repeatedly breaches the internal rules.
17. Physical condition and responsibility of the student
The practice of yoga involves physical activity, postures, breathing exercises, relaxation and other body or attention techniques.
The student declares that he or she is in adequate conditions to carry out the contracted activity or, in case of doubt, that he or she has previously consulted with a health professional.
The student must inform the teacher or the Center of any injury, ailment, pregnancy, physical limitation, illness, medical treatment or relevant circumstance that may affect the practice.
The Centre and its professionals will act with due diligence, but are not responsible for injuries, inconvenience or damages arising from the concealment of relevant information by the student, the incorrect performance of the exercises, the failure to comply with the teacher’s instructions or personal circumstances not communicated.
18. Personal Items
The student is responsible for his/her personal belongings within the school.
The Centre is not responsible for loss, theft, damage or misplacement of personal belongings, except in legally required cases.
19. Protection of personal data
The personal data provided by the student will be treated in accordance with the Privacy Policy published on the Urvashi Yoga Estudio website.
The data may be used to manage contracting, reservations, payments, administrative communications, service provision and student care.
The student may exercise their rights of access, rectification, deletion, opposition, limitation and portability under the terms provided for in current regulations, by contacting the Centre through the contact channels indicated.
20. Payment Security
Online payments are made through secure payment platforms. Bank card or Bizum transactions will be processed by the corresponding bank or payment provider.
The Centre does not have full access to and does not store the student’s sensitive banking details, such as the full card number, CVV code or other equivalent authentication data.
In the event of a technical incident during payment, the student must contact the Centre to check the status of the operation before making a new payment attempt.
21. Communications
Communications between the Centre and the student may be made by email, telephone, WhatsApp or other means provided by the student or enabled by the Centre.
The student undertakes to provide truthful and up-to-date contact details in order to correctly receive notices related to payments, classes, schedules, changes, cancellations or any other relevant information about the contracted service.
22. Modification of these Terms and Conditions
The Centre may modify these Terms and Conditions to adapt them to regulatory, technical, organisational, commercial or internal operational changes.
The current version will be available on the website. The modifications will not affect services already paid for and in progress, unless they are necessary for duly justified legal, technical or organisational reasons.
23. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by Spanish law.
In the event of a dispute, the parties will try to resolve it amicably. If this is not possible, they will be submitted to the courts and tribunals that are competent in accordance with the applicable regulations on consumers and users.
24. Acceptance of the Terms
By contracting any of the services offered by Urvashi Yoga Studio, making a payment, reserving a place or activating a recurring fee, the student declares to have read, understood and accepted these Terms and Conditions.
In particular, the student expressly accepts the conditions relating to recurring payments, renewal of fees, cancellation of subscription, policy of non-refund of monthly payments paid and rules for making up classes.
